Inspection body in waste management - Apply for recognition

Testing laboratories and measuring bodies that wish to carry out analyses of waste and soil samples on the basis of individual legal ordinances require recognition as an analysis centre in the waste management sector in these areas.

Recognition is required for analyses in accordance with the following legislationsordinances:

  • Sewage Sludge Ordinance (AbfKlärV)
  • Biowaste Ordinance (BioAbfV)
  • Waste Wood Ordinance (AltholzV)

You can obtain recognition for individual areas or for all areas.

Note: The LUBW is responsible for investigation centres that have their registered office in Baden-Württemberg or investigation centres that wish to operate primarily in Baden-Württemberg.

Prerequisite

Certain personnel, organisational and equipment requirements must be met for recognition as an examination centre.

Personnel requirements

  • The management of the testing centre must
    • be professionally qualified and have at least threeiyears of professional experience in chemical analysisyin chemical analysis.
      A university degree in chemistry, food chemistry or food analytics counts as a professional qualificationechemistry or comparable disciplines (e.g. Physics, biology, geology).
    • have a sufficiently qualified deputy.
      The laboratory manager or their deputy must work full-time.
  • The other staff must be sufficiently qualified (e.g. chemical engineers, chemists, chemists, chemists, etc.)echemical laboratory technicians or similar)hcomparable training).
    The number of employees depends on the area of responsibility. However, there should be at least three full-time employees.

Organisational requirements

  • The testing centre must maintain a quality management manual in accordance with DIN EN ISO/IEC 17025. It must provide proof of competence and declare its independence.
  • The personnel must fulfil their tasks and duties, in particularnparticularly with regard to quality assurance.
  • One or more persons must be responsible for carrying out and monitoring the quality assurance measures.
  • The inspection body must keep written records of its organisation and responsibilities and must be able tonup to date. The staff must have access to the documents at all times.
  • As a rule, the inspection body carries out the sampling. In exceptional cases, other testing centres or external samplers may be commissioned.

Equipment requirements

  • The testing centre must have a general laboratoryoequipment.
  • The technical equipment must ensure that the tests can be carried out properly and that the necessary tests can be performediand the necessary quality assurance measures.
  • The equipment must be regularly maintained and cacalibration. Records of the maintenance and calibriethe inspection body must keep records of maintenance and calibration for at least three years.
  • The waste and waste water produced must be disposed of by the inspection bodyuthe examination centre must dispose of the waste and waste water properly and clean the exhaust air.

Procedure

The application for recognition as an inspection body in the waste management sector must be submitted in writing to the competent authority. Recognition is revocable. The investigation task for which authorisation is to be granted must be specified in the application.
The application form and other documents required for the application (declaration of commitment, list of procedures for the application for recognition) can be requested informally by sending an e-mail to Post-ASUS@lubw.bwl.de or downloaded here .

The competent body checks the application documents for completeness and then confirms receipt of the application in writing or by e-mail. If documents are missing, the competent body will request that they be submitted within a reasonable period of time. Once the complete documents have been received and all requirements have been met, the competent body will issue recognition by means of a decision.

Deadlines

Recognition ends after 5 years at the latest. Recognition can be extended upon application. The application for renewal must be submitted at least 3 months before the recognition expires.

The LUBW has a processing period of 3 months after receipt of the complete application documents (initial application, amendment application and renewal application).

Required documents

The following documents must be submitted to the Landesanstalt für Umwelt Baden-Württemberg for recognition as an inspection body in waste management:

  • Accreditation documents (accreditation notice, accreditation certificate and the last assessment report)
  • Application form
  • Declaration of commitment (form provided by the competent body on the Internet)
  • Consent to the storage and processing of personal data (provided with the application form)
  • CVs and certificates of good conduct for the laboratory manager and deputy laboratory manager
  • Proof of liability insurance
  • List of procedures

Note: In the case of an extension of the recognition, only the list of procedures and the declaration of commitment must be attached to the application - provided that it is ensured that the documents available to LUBW from the initial application are up to date.

Costs

A fee is charged for the recognition, withdrawal or rejection of an application, the extension and revocation of recognition. The fee is charged according to the cost and scope of the recognition procedure. The fee is set in accordance with Sections 4 and 7 of the State Fees Act (LGebG) of 14 December 2004 (GBl. p. 895) in conjunction with Section 10.1 of the Ordinance of the Ministry of the Environment and the Ministry of Food and Rural Areas on the Fees of the State Institute for the Environment, Measurements and Natural Protection of Baden-Württemberg (Fee Ordinance - LUBW) of 1 December 2006 (GBl. No. 15, p. 387), as amended.

Processing time

The processing time depends on the scope of the recognition, but is a maximum of 3 months from receipt of the complete application.

Miscellaneous

Laboratories that have been recognised must regularly take part in quality assurance measures (round robin tests).
The LUBW announces the interlaboratory tests requiring participation at the beginning of each year.

Recognition is generally valid for five years. However, the competent body can revoke it at any time.
For laboratories that prove their competence by means of an accreditation, the recognition is valid until the accreditation expires.
