Applying for a gun ownership licence in the event of inheritance
Have you inherited a weapon requiring a licence and want to keep it? Then you will need a gun ownership licence.
Please note: Have you found or taken possession of weapons after the death of the previous weapons owner? Then you must report this immediately to the relevant weapons authority. Anyone who owns weapons or ammunition must take the necessary precautions to prevent these items from being lost or taken by unauthorised third parties. Firearms and ammunition that are subject to authorisation must be kept in the prescribed safety containers.

If you wish to keep an inherited firearm that requires a licence, you must apply in good time as an Heir must apply for the issue of a firearm ownership licence for the firearm subject to authorisation belonging to the estate or its entry in an already issued firearm ownership licence.
If you do not wish to keep the inherited firearm, you can hand it in to the firearms authority or a police station. The weapon will then usually be destroyed.

The installation of the blocking system must be proven to the firearms authority.
Caution: Unauthorised handling of weapons and ammunition is a criminal offence - in certain cases an administrative offence.

The installation and unlocking of blocking systems may only be carried out by holders of a firearms manufacturing licence or a firearms trading licence who have been instructed in this or by their authorised employees. The federal government has issued regulations on this in the "Technical Directive - Blocking Systems for Inherited Weapons". Procedure
If you are not yet the holder of a firearms licence, you must apply to the relevant firearms authority for a firearms licence. The application form is available there. Some authorities offer the application form for download.
The competent weapons authority will check whether you have the necessary reliability. In particular, it will obtain the following information:
- Information from the Federal Central Criminal Register
- Information from the central public prosecutor's register of proceedings
- Statement from the State Office of Criminal Investigation
- Statement from the Federal Police Headquarters
- Statement from the Customs Criminal Police Office
- Statement from the State Office for the Protection of the Constitution
The competent weapons authority will also check your personal suitability and obtain the following information:
- Statement from the State Office of Criminal Investigation
- Statement from the Federal Police Headquarters
- Statement from the Customs Criminal Police Office
If the competent authority has concerns as to whether you are personally suitable, it may request a
- an official or specialised medical certificate or
- a specialised psychological certificate.
You must provide proof of the installation of the blocking system.
Deadlines
As heirs, you must apply within one month of accepting the inheritance or the expiry of the period prescribed for waiving the inheritance for the issue of a firearms ownership licence for the firearms subject to authorisation belonging to the estate or for their entry in an already issued firearms ownership licence.

The amount of the fees depends on the municipal fee regulations. Please enquire at the responsible office.
Miscellaneous
You must store and transport your weapons in such a way that they cannot be accessed by third parties. Firearms and ammunition subject to authorisation may only be stored in suitable safety containers. The weapons must not be loaded during transport and must always be in a locked container.
If you violate these security obligations, you must expect a fine and confiscation of the weapons. In the case of serious offences, you may even face a prison sentence.
